Your Rights When Buying A Car From A Dealer
When you buy a car from a dealer, you are entering into a contract that is governed chiefly by the Sale of Goods Act, 1979. The Sale & Supply of Goods Act, 1994 and the Sale and Supply of Goods to Consumers Regulations, 2002 also give the buyer certain rights.
The Act says a car must be of satisfactory quality, fit for purpose and as described.
A car of satisfactory quality is a car that is as good quality from the point of view of a reasonable or average member of the public, bearing in mind the price paid and how the dealers description of the car. The safety, durability and appearance of the vehicle are to be taken into account when establishing whether the vehicle is of satisfactory quality. The standard you can reasonably expect depends on the mileage of the car, how much you paid for it and the age of the car.
New cars have to be free from even minor defects for them to meet the criteria of satisfactory quality.
To be fit for purpose the vehicle should be capable of doing what you would expect for a car of its price, size and type. It should also do what the dealer promised.
A car that is as described is a vehicle that corresponds in every detail to the advert you saw for it. If it is a second-hand car, the mileage should be genuine and anything you are told about its history should be true. A new car should be unused and in perfect condition.
If the car you have brought does not live up to the above standards, you have the right to complain to the dealer. They should compensate you or give you a refund. It is best to make you complaint in writing, clearly stating what the issues are. Most dealers are very good at resolving issues once they are made aware of them. In the event that you do not manage to solve the problem amicably, you can contact your local Trading Standards Office.
